5. Secondary-Market Products

Products sold by AIPG may be sourced through:

  • Surplus inventories;

  • Facility closures;

  • Industrial auctions;

  • Equipment dealers;

  • Removed machinery;

  • Resellers; or

  • Other secondary-market sources.

  • For parts or not working.

The condition stated in the applicable product listing controls.

“New surplus” does not necessarily mean that a product is currently manufactured, obtained through an authorized distribution channel, covered by a manufacturer warranty, or packaged in current retail packaging.

Packaging may show storage wear, writing, labels, discoloration, shelf wear, prior shipping labels, or other cosmetic evidence associated with storage or secondary-market distribution.

6. Manufacturer Warranties

Unless expressly stated otherwise in the applicable product listing, products sold by AIPG are not represented as being covered by an original manufacturer warranty.

Because products may be obtained through surplus, liquidation, auction, removed-equipment, reseller, or other secondary-market channels, an original manufacturer warranty may be:

  • Unavailable;

  • Invalid;

  • Expired;

  • Nontransferable;

  • Limited to the original purchaser;

  • Limited to an authorized distribution channel; or

  • Otherwise not honored by the manufacturer.

AIPG does not administer, extend, reinstate, guarantee, or represent the continued validity of any manufacturer warranty.

Any reference to a manufacturer warranty is informational only unless AIPG expressly confirms in writing that the warranty applies to the particular product and purchaser.

Any separate warranty offered directly by AIPG will be expressly stated in the applicable product listing or written sales agreement.

7. Product Information

We make reasonable efforts to provide accurate product:

  • Specifications;

  • Conditions;

You are solely responsible for determining whether a product is suitable for your intended application.

This responsibility includes confirming whether the product requires:

  • Configuration;

  • Calibration;

  • Licensing;

  • Firmware changes;

  • Additional hardware;

  • Accessories; or

10. Installation and Safety

Industrial electrical, electronic, automation, and mechanical products can create risks of:

  • Electric shock;

The purchaser is responsible for proper safeguards, redundancy, engineering review, risk assessment, testing, certification, and regulatory compliance.

12. Testing and Operational Representations

Any product testing performed by AIPG is limited to the testing expressly described in the product listing.

Terms such as:

  • “Tested”;

  • “Powers on”;

  • “Working when removed”;

  • “Removed from operating equipment”; or

  • “Operational when removed”

do not mean that every function, input, output, communication port, memory location, accessory, firmware feature, or operating mode has been tested.

“Powers on” means only that the product demonstrated a power response during limited observation. It does not mean that the product was fully function-tested, calibrated, certified, or tested under load.

Products listed as “for parts or not working” may be incomplete, damaged, nonfunctional, unsafe, or unsuitable for installation.

Such products must be inspected by qualified personnel before any use or attempted operation.

13. Account Information

Certain website features may allow or require you to create an account.

You are responsible for:

  • Maintaining the confidentiality of your account credentials;

  • Restricting access to your account and devices;

  • Providing accurate account information; and

  • Promptly notifying us of suspected unauthorized account activity.

19. Shipping and Delivery

Delivery dates and carrier transit times are estimates unless an express written guarantee is provided.

You are responsible for providing a complete and accurate delivery address.

Risk associated with loss, delay, damage, refusal, theft after confirmed delivery, freight access, and customs processing is addressed in the Shipping Policy and applicable law.

20. Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy and any product-specific terms shown in the listing.

Unless otherwise stated, eligible returns must be requested within the stated return period.

Returned products must:

  • Include all parts and accessories originally supplied;

We may document serial numbers, date codes, security marks, product condition, weight, and packaging before shipment.

We may deny or reduce a refund when:

  • The product was damaged after delivery;

  • The product was altered or disassembled;

  • The product was improperly installed;

  • The return was unauthorized;

  • The return deadline was missed; or

Nothing in this section limits any right that cannot legally be waived.

21. Order Cancellations

We will make reasonable efforts to accommodate a cancellation request, but we cannot guarantee cancellation after processing has begun.

An order generally cannot be canceled after transfer to the shipping carrier. The customer may instead be required to follow the applicable return procedure.

22. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY PROVIDED DIRECTLY BY AIPG, THE WEBSITE, WEBSITE CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITH ALL FAULTS.

AIPG DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, CONDITION, QUALITY, DURABILITY, ACCURACY, COMPATIBILITY, AND QUIET ENJOYMENT.

AIPG DOES NOT WARRANT THAT:

  • Products will be compatible with a particular application;

  • Inability to access the website;

These limitations do not apply to liability that cannot legally be excluded or limited.

24. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless AIPG and its owners, members, officers, employees, contractors, affiliates, suppliers, and agents from claims, liabilities, judgments, damages, penalties, losses, costs, and reasonable legal fees arising from or relating to:

This provision does not require indemnification for liability that cannot lawfully be transferred.
